Arrest MLA Sengar immediately, Allahabad High Court directs CBI

Taking suo motu cognisance of the letter, the court admitted it as a PIL.

The FIR itself came days after the Unnao girl tried to self-immolate in front of Chief Minister Yogi Adityanath's house on Sunday accusing authorities of inaction, and the death of her father in custody the next day allegedly after being beaten up by the politician's brother and their henchmen in front of policemen. Several hours before the main accused, BJP MLA Kuldeep Singh Sengar, was held by the CBI in the evening, the HC questioned the UP advocate general for the delay in his arrest.

Sengar had been moving around freely, denying the accusations, making disparaging comments about the girl and her family and hitting out at the media in the Unnao rape case. He was charged under sections 363 (kidnapping), 366 (abduction of woman), 376 (rape), 506 (criminal intimidation) of the Indian Penal Code (IPC) and Protection of Children from Sexual Offences (POCSO) Act.

The court directed the CBI to carry out investigation strictly in accordance with law and to consider filing an application for cancellation of bail granted to other accused in the case.

The bench of Chief Justice DB Bhosale and Justice Sunit Kumar also said that it will monitor the probe in the rape case, further directing that the MLA should be arrested and not just detained.

Earlier on Thursday, the UP Director General of Police OP Singh, at a press conference said, "Now that the case has been given to CBI, they will decide on the arrest issue". I believe the CBI would have arrested the MLA also.

Sengar, on Wednesday night, asked the Lucknow police to call him if there was an arrest warrant against him. "I have come here because TV channels were saying I will surrender", he appeared to taunt reporters, insisting that he was neither a fugitive nor a rapist. "Have you arrested Sengar?"

To recall, the victim's father was in judicial custody since April 4, after he got into a fight with the aides of the MLA's brother, Atul Sengar. It has re-registered the three first information reports filed by the state police in the case.

Chaturvedi also demanded fair investigation in the heinous crime and later, on the death of the victim's father.

The legislator welcomed the decision of the UP government to conduct a CBI probe and asserted that the findings of the central agency will aquit him from all "false" charges.

After the reports of supporters of Sengar clashing with mediapersons on Wednesday night, the Principal Secretary (Home) said that the government has chose to provide adequate security to the family of the victim and witnesses in the case.

It further added that the father of the Unnao rape victim wouldn't have died had the police acted on the complaint filed by the girl in August, last year.
