PH Supreme Court ousts chief justice


The justice committee of the House of Representatives, which conducted impeachment proceedings against her following a complaint filed by lawyer Larry Gadon, found probable cause to unseat her and would elevate its recommendation to the plenary which would vote on whether to affirm of dismiss the case.

"This decision is the epitome of its exercise of judicial independence", Calida said in a statement on Friday, May 11, just after the SC en banc chose to oust Sereno by a tight vote of 8-6.

Atty. Oliver Lozano filed a petition to the High Court to invalidate Sereno's appointment on the ground that the top magistrate failed to comply with mandatory legal requirements.

The Supreme Court gave her camp 10 days to appeal the decision.

Calida earlier said Sereno is not qualified to hold the position.

Ousted Philippine Chief Justice Maria Lourdes Sereno has emerged from the Supreme Court after her colleagues voted to remove her and is asking hundreds of protesting supporters to organize a movement to defend justice and accountability.

Solicitor General Jose Calida scores another victory as he successfully ousts a chief justice in a process that is not impeachment. "Ang araw na ito ang araw ng paglaban", she said. "Allow the Chief Justice to defend herself in the impeachment trial", the statement reads.

She says the justices who voted to boot her out of the 15-member tribunal seized "the sole responsibility of the Senate, brazenly violated their sworn responsibility to protect the constitution and destroyed the judiciary".

Senate President Aquilino Pimentel III is invoking the authority of the Senate over Chief Justice Maria Lourdes Sereno who today was ousted by the SC in its landmark decision favoring the quo warranto petition against her.

He added that Sereno should likewise be given the chance to appeal the ruling.

"Let the impeachment of the Chief Justice take its course as the Constitution dictates".

The respondent Chief Justice must be given the opportunity to file a Motion for Reconsideration. She also has been speaking up for the respect of law and human rights, irking Duterte at a time he has led a brutal crackdown on illegal drugs that has left thousands of suspects dead.
