Senate Complies With Court Order Nullifying Omo-Agege's Suspension


In a statement by its spokesperson, Sabi Abdullahi, the Senate said it has been briefed by lawyers on the court judgement nullifying Mr Omo-Agege's suspension.

Recall that the Senate had recently suspended Omo-Agege after he accused its leadership of aiming at President Muhammadu Buhari's re-election by trying to reorder the sequence of the 2019 general election.

The Senator representing Delta Central Senatorial district, Ovie Omo-Agege, has commended the conduct of the local government congresses of the All Progressives Congress (APC) in the state.

He established that Omo-Agege came in with seven unidentified persons dressed in black and native wears as he said six of them were arrested with him while one of the suspects escaped using the Presidential Villa gate.

"Having regard to the settled position of the law as expoused by our courts in not less than five cases wherein the suspension of legislators by legislative houses was annulled and set aside the Senate should withdraw the appeal filed against the judgment of the Federal High Court in the case of Senator Omo-Agege".

Following the judgement, an aide to Senate President, Bukola Saraki, said the Senate has approached a higher court to appeal the ruling and institute a stay of execution.

At the hearing on Tuesday, May 15, 2018, chairman of the committee, Bala Ibn Na'Allah, said the summon was sequel to the testimonies of the DPO, the SSS and the sergeant at arms at the National Assembly. A declaratory order is not ' stayable' in law.

"In the same vein, Colonel Sambo Dasuki ought to be released on bail in line with the orders of the Federal High Court, the High Court of the Federal Capital Territory and the Community Court of Justice Economic Community of West African States", Mr Falana stated. In any event that they apply for a stay, unless and until the court grants that stay, the judgment of the lower court is to take an immediate effect. That by itself is contempt. You can not be in contempt of the court and ask the same court to grant you an equitable relief. Therefore, he is not entitled to an equitable relief in court. They have the right to appeal and they have already filed it.

On Monday, NAN reports that security was beefed up at the National Assembly in anticipation of Mr Omo-Agege's resumption.

This was confirmed by another party leader, Olorogun O'tega Emerhor, who said the adoption of the unity list contributed to the success of the congress.The Guardian learnt that the outcome of the congresses were harmonised before the official result were announced to avoid a further rift in the party.
