The footage, given to by United Kingdom -based Sky News, shows a 2011 meeting in New York City in which Melissa Thompson, then 28 years old, is pitching her web video and analytics start-up to the Hollywood producer for the Weinstein Company.

The response from the Big Apple D.A. comes on the same day that Sky News has exclusive video of Weinstein sexually harassing Melissa Thompson in September 2011 in what was supposed to be a pitch meeting for a potential analytics service for the Weinstein Company.

A few hours afterwards, at a hotel nearby, Ms Thompson alleges that Weinstein raped her.

In an interview with Sky News, Thompson said Weinstein's behavior was distracting and she struggled to stay "on script" with the product pitch. Weinstein immediately brushes off Thompson's offer of a handshake and instead hugs her, his hand drifting down towards her waist as he rubs her back during the embrace.

It also shows her joking about his advances, saying that "data is hot".

Although it is unclear what he is doing on camera, Ms Thompson told Sky News he had run his hand up her leg under her dress and that she had not "purposely encouraged him".

"What they shared with us is that the video, when viewed in its entirety, in context and not in select excerpts, demonstrates that there is nothing forceful, but casual - if not awkward - flirting from both parties".

Weinstein has been indicted on sex crime accusations involving three women in NY but not Thompson, according to the AP. "It's okay. Would you like to do it some more?"

"A little high, a little high, that's a little high, that's a little high", Thompson replies.

"I was trying to save face a bit. trying to manage the situation". But after they met, that's where Weinstein led her anyway and that's where Thompson said he raped her.

Ms Thompson replies: "Ummm we'll see, a little bit".

Along the way, she said, he rebuffed her attempts to fight or get away.

In the footage, Weinstein invites Thompson to join him at the Tribeca Grand Hotel lobby restaurant.

"Anything short of that is meant to make Mr. Weinstein appear inappropriate, and even exploitative", said Benjamin Brafman. I constantly felt trapped, no matter where I turned.

Thompson's rape allegation is part of a class action lawsuit against the former Hollywood producer, whose career was toppled by a series of rape, sexual assault and harassment allegations previous year. "This is a further attempt to publicly disgrace Mr Weinstein for financial gain and we will not stand for it. Facts do matter". She told Sky News she was expecting that this would be a follow-up meeting to close the deal. "I thought I could handle it, I had never met anyone that I couldn't handle... until Harvey Weinstein".

The meeting goes on like that from there.

Separately on Wednesday, a federal judge in Manhattan heard arguments over whether a civil lawsuit brought by six women against both Weinstein and men on the board of his film company should go forward.

Once in the room, he raped her.
