The Oscar victor will be questioned on a forcible touching complaint filed by a 29-year-old woman who claims he grabbed her breast at Magic Hour Rooftop Bar & Lounge in Manhattan on Sunday.

He told TMZ: "I trust the system and the process speaks for itself".

TMZ caught up with Gooding late Tuesday as he was about to board a flight back to New York City from Los Angeles, where he said he is "absolutely not" guilty of what he's been accused of.

Gooding Jr. claims he was at the club partying with friends, but that nobody was touched inappropriately. "There's a tape that shows what really happened - that's the most important thing". The actor said he went to a bar, talked and took pictures with people, and left.

Asked about the reported allegation on Monday, NYPD spokesman Detective Martin Brown said, "We don't really have anything official to say about it other than that there's been an allegation and that it is now under investigation".

Gooding will surrender to the NYPD special victims unit that's leading the investigation before going to court for an arraignment, Heller said.

The "Boyz In The Hood" actor has continued to deny that the claim is true.

Gooding won the Academy Award for best supporting actor in 1997 for his portrayal of an athlete in the film "Jerry Maguire".

Gooding was nominated for an Emmy Award previous year for playing O.J. Simpson in the series The People v. O.J. Simpson and recently appeared on Broadway and London's West End as lawyer Billy Flynn in Chicago.
